California Environmental Quality Act (CEQA) - Environmental Documents

Discretionary projects, both public and private, are subject to environmental review under the California Environmental Quality Act (CEQA) (Public Resource Code §§21000, et. seq.) and the CEQA Guidelines (California Code of Regulations, §§15000 et, seq).

Based on the review of the potential environmental impacts, the Town determines the appropriate environmental document for the project, which could include a(n):

  • Notice of Exemption (NOE) for projects that are statutorily or categorically exempt from CEQA;
  • Negative Declaration (ND) for projects that are not exempt but would not have a significant effect on the environment;
  • Mitigated Negative Declaration (MND) for projects for which all significant environmental impacts can clearly be mitigated to less-than-significant levels; or
  • Environmental Impact Report (EIR) for projects that have the potential to result in one or more significant environmental impacts.
